2nd Vioxx Lawsuit Goes to Trial

Seeger Weiss's client, Frederick "Mike" Humeston, is a 60 year old postal worker from Boise, Idaho. A former United States Marine, Mike was twice-awarded a purple heart for service to his country in Vietnam.

As a result of his combat injury, Mike Humeston regularly took pain relievers. On September 18, 2001, Mike Humeston took two 25 mg tablets of Vioxx. Approximately two hours later he suffered a heart attack. Mike began taking Vioxx in May 2001, and prior to his heart attack, had been taking the drug regularly for two months.

Mike Humeston maintains that long before Vioxx was first marketed in the United States, Merck knew that the drug carried cardiovascular risks. Further, Mike contends that had Merck warned doctors and patients of the drug's risks, he would never have taken Vioxx.

Mr. Humeston further contends that Merck engaged in deceptive and unconscionable practices in connection with the marketing and sale of Vioxx.

The trial against Merck and Vioxx on behalf of Mr. Humeston began with jury selection on September 12, 2005, in the Superior Court of New Jersey seated in Atlantic City. Opening statements are scheduled for Wednesday, September 14, 2005 and are expected to be covered by Court TV. The Honorable Carol E. Higbee will be presiding over the trial.
